Certain features are powered by Anec Assist, our optional artificial intelligence technology, which helps educators prepare documentation more efficiently while ensuring that educators remain responsible for reviewing and approving all content before it becomes part of a student’s educational record.

We recognize that the information entrusted to anecNote is both personal and sensitive. Educational documentation may include information about children, classroom activities, developmental progress, learning experiences, educator observations, photographs, voice observations, reports, and other records created to support teaching and learning. Protecting that information is fundamental to our mission. We are committed to handling personal information responsibly, maintaining appropriate administrative, technical, and organizational safeguards, and being transparent about how information is collected, used, stored, shared, retained, and protected.

1. Introduction

“Content” means any information submitted, uploaded, recorded, generated, or stored through the Service, including text, photographs, audio recordings, documents, reports, learning stories, comments, attachments, and other materials.

“Anec Assist” refers to anecNote’s optional artificial intelligence features that assist users with drafting observations, organizing documentation, generating summaries, identifying potential follow-up opportunities, suggesting educational insights, and supporting other documentation workflows. Anec Assist provides recommendations only and does not make educational, behavioral, disciplinary, grading, placement, or safeguarding decisions on behalf of educators or educational organizations.

“Processing” means any operation performed on information, whether by automated or manual means, including collecting, recording, organizing, structuring, storing, adapting, retrieving, using, transmitting, disclosing, combining, restricting, deleting, or destroying information.

“Third-Party Service Provider” means a company or organization that performs services on behalf of anecNote to help operate, secure, maintain, or improve the Service. Examples include cloud infrastructure providers, payment processors, authentication providers, analytics providers, customer support platforms, and artificial intelligence service providers.

“Applicable Privacy Laws” means the privacy, education, consumer protection, and data protection laws and regulations that apply to the use of the Service based on the jurisdiction of the User or Organization. These may include, where applicable, laws governing educational records, children’s privacy, consumer privacy, and international data protection.

3. Who We Are

AnecNote is developed and operated by anecNote AI, an educational technology company dedicated to helping educators document learning in a way that is secure, efficient, and meaningful. Our platform is designed to support teachers, school leaders, counselors, learning support professionals, specialists, and educational organizations by providing tools to capture observations, organize evidence of learning, and create high-quality educational documentation.

Our mission is to reduce the administrative burden associated with student documentation while supporting professional judgment, educational reflection, and evidence-based decision-making. Through features such as voice observations, photo documentation, learning stories, progress reports, and Anec Assist, we aim to help educators spend less time managing paperwork and more time supporting student learning.

AnecNote is intended for use by authorized educational professionals and organizations. The Service is not designed for direct use by children or students as end users. Students do not create or manage anecNote accounts, and we do not knowingly collect personal information directly from children through the Service. Information relating to students is provided by authorized educators or educational organizations for legitimate educational purposes and is processed in accordance with this Privacy Policy, our agreements with educational organizations, and applicable laws.

Depending on how the Service is provided, anecNote may act either as a service provider processing information on behalf of a school or educational organization, or as a service provider to an individual educator using the platform independently. Our responsibilities may differ depending on the nature of the relationship, but our commitment to protecting personal information remains the same.

4. Scope of This Privacy Policy

In other cases, the Service may be used directly by an individual educator through a personal subscription. Independent educators should not upload or process information that they are not authorized to collect or maintain.

Ownership of Educational Records

Educational documentation created through the Service, including observations, learning stories, reports, photographs, voice observations, documentation, and related records, remains under the control of the educator or educational organization that created or submitted it, subject to applicable agreements and law.

AnecNote does not claim ownership of educational records created by users.

How anecNote Uses Information

AnecNote processes information solely to:

• Provide and operate the Service.
• Secure and maintain the platform.
• Generate reports and documentation requested by users.
• Deliver optional Anec Assist features.
• Respond to customer support requests.
• Improve the reliability, accessibility, and performance of the Service.

All recommendations generated by Anec Assist are subject to review and approval by an authorized educator before they become part of a student’s educational record.

6. Information We Collect

The information anecNote collects depends on how the Service is used, the features you choose to access, and whether the Service is provided through an educational organization or an individual subscription. Some information is provided directly by users, some is generated through the normal operation of the Service, and some is collected automatically to maintain security, improve performance, and provide requested features.

Where supported, anecNote may remove unnecessary image metadata before storing uploaded photographs to help protect privacy.

The Service is designed to assist educators in documenting learning more efficiently while preserving educator ownership and professional judgment.

7.3 Artificial Intelligence Features

When users choose to use Anec Assist, selected information may be processed to:

• Generate documentation drafts.
• Improve writing clarity.
• Organize observations.
• Summarize educational information.
• Suggest documentation categories.
• Recommend follow-up opportunities.
• Generate learning stories.
• Assist with report preparation.

Anec Assist provides recommendations only. AI-generated content is never automatically added to a student’s educational record and must always be reviewed, edited where appropriate, and approved by an authorized educator.

7.4 Communication

We may use contact information to communicate with users regarding:

Where required by law, users may choose whether to receive promotional or marketing communications. Essential service-related communications cannot generally be disabled while an account remains active.

8. Anec Assist and Artificial Intelligence

AnecNote includes optional artificial intelligence (“AI”) features known as Anec Assist. These features are designed to support educators by reducing the time required to prepare educational documentation while preserving professional judgment and educator oversight.

Anec Assist is intended to assist, not replace, the expertise of educators. AI-generated content is provided as a drafting and productivity tool. Educators remain responsible for reviewing, editing, verifying, and approving all AI-generated content before it becomes part of a student’s educational record or is shared with others.

The use of Anec Assist is optional. Users may choose whether to use AI-powered features, and many core features of the Service remain available without AI assistance.

8.1 How Anec Assist Uses Information

When an educator requests an AI-assisted feature, Anec Assist processes only the information necessary to complete that request.

Depending on the feature being used, this may include:

8.3 What Anec Assist Does Not Do

• Make disciplinary decisions.
• Identify safeguarding concerns without educator review.
• Replace educator judgment.
• Communicate directly with students or families.
• Create official educational records without educator approval.

Educational decisions remain the responsibility of qualified educators and educational organizations.

8.4 AI Service Providers

To provide Anec Assist, anecNote may use trusted third-party artificial intelligence providers to process information submitted by users.

These providers process information only as necessary to deliver the requested AI functionality and are contractually required to protect information in accordance with applicable agreements and legal requirements.

A current list of significant service providers is available in Appendix A – Subprocessors and may be updated from time to time as our infrastructure evolves.

8.5 Improving AI Features

AnecNote continually improves Anec Assist to increase the quality, reliability, accessibility, and usefulness of AI-generated documentation.

Where possible, improvements are based on:

We seek to minimize the use of identifiable personal information for AI improvement activities wherever practical and appropriate.

Where an AI-generated response appears inaccurate or inappropriate, users should edit or disregard the content and may report the issue to anecNote to help us improve the Service.

9. Voice Observations, Photographs, and Media

AnecNote allows authorized users to create, upload, and manage media as part of educational documentation. Media features are designed to help educators efficiently capture evidence of learning while maintaining appropriate privacy, security, and educator control.

Media submitted through the Service is processed only for legitimate educational purposes and in accordance with this Privacy Policy, applicable agreements with educational organizations, and applicable law.

9.1 Voice Observations

Voice observations allow educators to document learning by recording spoken observations instead of typing notes.

When a user records a voice observation, anecNote may process:

• Other documentation intentionally captured by educators.

Photographs should only be uploaded where the educator or educational organization has the appropriate authority to do so.

9.3 Image Processing

When users request AI-assisted image features, uploaded photographs may be processed to:

• Describe visible learning activities.
• Assist with documentation.
• Support report preparation.
• Generate learning stories.
• Identify educational themes selected by the educator.

Image processing occurs only when initiated by an authorized user.

9.4 Media Metadata

Digital photographs and audio recordings may contain technical metadata generated by the recording device.

Where supported by the Service, anecNote may remove or limit unnecessary metadata before storing uploaded media. Examples of metadata that may be removed include:

• Device-specific metadata not required to operate the Service.

Certain technical information necessary for processing, synchronization, security, or troubleshooting may still be retained.

Voice recordings, photographs, and other media remain associated with the educational documentation created by authorized users until they are deleted, exported, or otherwise managed in accordance with the retention settings established by the educator or educational organization.

9.8 User Responsibilities

Because media may contain sensitive educational information, users should exercise professional judgment before capturing or uploading content.

Authorized users are responsible for ensuring that:

• They have appropriate authorization to capture or upload the content.
• Uploaded media complies with applicable school policies and legal requirements.
• Media does not include unnecessary personal or sensitive information unrelated to the educational purpose.
• AI-generated descriptions are reviewed for accuracy before they are used in educational documentation.

The protection of student privacy is a shared responsibility between educational organizations, educators, and anecNote.

10. Cookies, Analytics, and Similar Technologies

When you use the anecNote website or web workspace, we may collect certain information automatically through cookies and similar technologies. These technologies help us operate the Service, remember user preferences, improve performance, understand how the Service is used, and protect the security of our platform.
